These Terms of Service govern your use of the Atheryx platform, website, and SDKs. By creating an account or using any Atheryx service, you agree to these terms.
Acceptance of Terms
By accessing or using Atheryx, you agree to be bound by these Terms and all applicable laws. If you do not agree, do not use the platform. Continued use after updates take effect constitutes acceptance of the revised terms.
Eligibility
- •You must be at least 13 years old to use Atheryx.
- •You must be legally able to enter into binding contracts.
- •Business accounts must be authorized by the business to accept these terms.
Accounts & Credentials
- •You are responsible for safeguarding your account credentials, application secrets, and license keys.
- •You must not share your application secret with unauthorized parties.
- •You must provide accurate registration information and keep it updated.
- •You may not create accounts for the purpose of circumventing platform restrictions.
Acceptable Use
- •You may not use Atheryx to infringe the intellectual property of others.
- •You may not reverse engineer, decompile, or attempt to extract the source of Atheryx cloud services.
- •You may not attempt to bypass, disrupt, or abuse the platform, its rate limits, or its security controls.
- •You may not use Atheryx to store or distribute malware, illegal content, or content that violates applicable law.
Subscriptions & Payments
- •Paid plans are billed monthly as selected at checkout.
- •Enterprise tier is billed monthly; cloud-hosted features require an active subscription.
- •Refunds are considered on a case-by-case basis within 14 days of purchase for unused subscriptions.
- •If a subscription lapses, license validation for that application is paused until renewal.
Enterprise Plan
- •The Enterprise plan includes unlimited applications, licenses, and API calls, real-time analytics, custom SDK support, and dedicated infrastructure.
- •All deployments on AtheryX remain subject to these Terms and applicable export-control laws.
- •Enterprise-level features and dedicated support are provided under an active monthly subscription.
Service Availability
We aim for 99.9%+ availability but do not guarantee uninterrupted or error-free service. The platform may be unavailable for maintenance, upgrades, or reasons outside our control. We are not liable for downtime-related losses.
Intellectual Property
Atheryx, including its design, documentation, and branding, is owned by the Atheryx team. You retain ownership of your applications and data. You grant us a limited license to store and process your data solely to provide the service.
Limitation of Liability
To the maximum extent permitted by law, Atheryx shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business opportunities arising from your use of the platform.
Termination
- •You may terminate your account at any time from the dashboard or by contacting support.
- •We may suspend or terminate accounts that violate these Terms, threaten platform security, or engage in abuse.
- •Upon termination, your license validation services cease; you may export your data before termination.
Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which Atheryx operates. Disputes will be resolved through good-faith negotiation before any formal proceedings.
